By creating a ChefMarket account, you ("Chef Partner" or "you") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable local, state, and federal laws and regulations. If you do not agree to these Terms, you may not use ChefMarket.
These Terms constitute a legally binding agreement between you and CloudFran Technologies, Inc. ("ChefMarket," "we," "our," or "us"). We reserve the right to update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
To register as a Chef Partner, you must:
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@chefmarket.online of any unauthorized use.
Chef Partners designated as "Home Chef" or operating from a residential kitchen acknowledge and agree:
Professional Chefs operating from commercial kitchens must maintain all required health department permits, food service establishment licenses, and comply with applicable commercial food production regulations.
All Chef Partners must:
ChefMarket charges a platform fee on each transaction:
Example: A $65 order on the Starter plan: $65 × 12% + $0.75 = $8.55 platform fee. Chef receives $56.45 before Stripe processing fees.
Subscription fees are billed monthly and are non-refundable. Downgrading your plan takes effect at the next billing cycle.
All payments are processed through Stripe. By accepting payments through ChefMarket, you agree to Stripe's Terms of Service. To receive payouts, you must:
ChefMarket is not responsible for Stripe payment processing errors, holds, or disputes. Stripe processing fees (approximately 2.9% + $0.30) are separate from ChefMarket's platform fee.
When you receive an order, you agree to:
Cancellation of confirmed orders without cause may result in account penalties. Repeated cancellations may result in account suspension.
On-demand delivery via DoorDash Drive is available to Professional Chef Partners only. Home Chefs operating under cottage food laws are limited to direct consumer pickup except in states explicitly permitting cottage food delivery.
For delivery-eligible Professional Chefs:
ChefMarket operates a verified review system. Reviews are submitted by customers who have completed orders. You may not:
You may respond professionally to reviews through your Dashboard. ChefMarket reserves the right to remove reviews that violate our community standards.
The following are strictly prohibited on ChefMarket:
You agree to defend, indemnify, and hold harmless CloudFran Technologies, Inc., its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
This indemnification obligation will survive the termination of your account and these Terms.
To the maximum extent permitted by applicable law, ChefMarket and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:
In no event shall ChefMarket's total liability to you exceed the greater of (a) $100 or (b) the amounts paid by you to ChefMarket in the twelve months preceding the claim.
By submitting photos, descriptions, recipes, or other content to ChefMarket, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the ChefMarket platform. You retain ownership of your original content.
You represent that you own or have the right to use all content you submit, and that such content does not infringe any third party's intellectual property rights.
Your use of ChefMarket is also governed by our Privacy Policy. We collect and process data as described in that policy, including order history, customer interactions, and payment information. We do not sell your personal data to third parties for marketing purposes.
Customer data (names, emails, addresses) provided through orders may only be used to fulfill those specific orders. Using customer data for unsolicited marketing is prohibited and will result in account termination.
Either party may terminate this agreement at any time. You may close your account through your Dashboard settings. ChefMarket may suspend or terminate your account immediately for:
Upon termination, outstanding earned funds will be paid out per Stripe's standard schedule, minus any amounts owed to ChefMarket or subject to dispute.
Any dispute arising from these Terms or your use of ChefMarket will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Atlanta, Georgia, or remotely by mutual agreement.
You waive any right to participate in a class action lawsuit or class-wide arbitration against ChefMarket. Each dispute must be brought on an individual basis.
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Subject to the arbitration provision above, you consent to the jurisdiction of the state and federal courts located in Fulton County, Georgia.
